Description of Service

The online and mobile music store is a service which allows you to purchase and/or bid for various music merchandises through the internet and your mobile phone (‘Service’). The list of products and items available for purchase can be viewed via the web at www.lelong.com.my/maxis and via wap portal at wap.lelong.com.my/maxis.

To use the Service, you will have to be a subscriber of Maxis' postpaid Or prepaid mobile service (Hotlink). The Service is a service provided by Maxis in collaboration with Interbase Resources Sdn Bhd, the owner of www.lelong.com.my (Lelong) and shall, in addition to these terms and the terms for Maxis M-money which can be found at http://www.maxis.com.my/personal/mobile/vas/emoney/tnc.asp, be subject to Lelong’s Terms and Conditions which can be found at http://www.lelong.com.my/Auc/Registration/UserAgreement.asp

Where applicable, access and usage of this Service shall also be subject to the General Terms and Conditions at http://www.maxis.com.my/personal/general/tnc_main.asp (which include terms and conditions for Website Use, the Rules of Acceptable Use and the Privacy Statement).

How to use the Service

You may only use this Service if you 18 years and above and capable of entering into legally binding contracts. If you are a minor (below 18 years of age), you can only use this Service with the consent and supervision of your parent or guardian.

You can view all merchandises available for purchase in the preview page on www.lelong.com.my/maxis. Products and merchandises can be purchased online or through your mobile phone. All products available for outright purchase can be purchased online and through your mobile phone but bidding can only be done via Lelong’s wapsite at wap.lelong.com.my/maxis. Bidding period for respective merchandise varies. You can view the closing time for bidding in respect of particular merchandise from the selected merchandise information. Remaining items that have not been successfully bid for or paid up, will be rolled forward to the next cycle or removed from listing or otherwise dealt with as deemed fit by Maxis.

Lelong will notify you via email if you are your purchase order is confirmed or if you are successful in a bid at the close of bidding cycle for an item.

Payment for each successful outright purchase or bid has to be made via M-Money within 3 days of being notified by Lelong. Purchases and bids are not retractable once you have paid for the products and merchandises. Delivery of the products and merchandises which you have paid for will be made/ arranged by Lelong in accordance to the terms of sale of each item.

Maxis and Lelong reserve the right to re-sell or re-auction any items which have not been successfully paid up by any subscribers.

Charges and Payment

Payment for all items purchased under this Service has to be made using M-Money. In addition to the purchase price for the products and merchandises, the following standard charges shall apply:

Data or standard charges will apply for any actions when using the Service, browsing the web and wapsite through your phone (eg SMS, GPRS/ 3G charges, browsing the Lelong’s sites);
When roaming, standard roaming and data charges including taxes/levies imposed by the roaming partners shall apply

Please note that you will be charged for all applicable charges relating to or in connection with the Services as set out above even if the charges were incurred by a third party using your mobile phone and/or the simcard registered to you and/or your details registered to your simcard. If the mobile phone does not belong to you or if someone else is paying the mobile phone bill please obtain that person's consent prior to using the Service or bidding.

Payment

You hereby agree to promptly pay all amounts due to Maxis as reflected in your official monthly bill statement and for all charges whatsoever for or occasioned by or in connection with the use of the Service irrespective of whether such charges were authorized by you or has arisen from any other causes whatsoever.

Termination and Suspension

Maxis reserves the right to cancel, modify, withdraw, terminate or suspend the Service for any reason whatsoever at its sole discretion without notice to you. You agree that Maxis shall not be liable to you or to any other party for such cancellation, modification, withdrawal, termination or suspension.

Restrictions and Prohibitions

You will abide by all specific conditions and all notifications issued by Maxis and Lelong in relation to the Service. If Maxis is of the view that there has been a contravention of these conditions, Maxis reserves the right to terminate and/or suspend your access and usage of the Service.

Disclaimer

The Service is provided on an "AS IS" basis without any representation or warranties of any kind whether express or implied. Maxis, its related and affiliated corporations disclaim and exclude all warranties relating to the items which are available for bidding, information, services relating to or in connection with the Services including but not limited to, all warranties of merchantability, fitness for a particular purpose, title, non-infringement, compatibility, security and accuracy.

In no event shall Maxis, its related and affiliated corporations be liable to you or anyone else for any loss or injury or any direct, indirect, special, exemplary, consequential damages, or any damages whatsoever including but not limited to loss of use, data, revenue or profits, whether in action of contract, negligence or other tortious action, arising out of or in connection with your use of the Service.

Maxis, its related and affiliated corporations do not warrant that the Service will be uninterrupted or error free, that defects will be corrected, or that the website or the server, third party or otherwise, that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials.
