TERMS & CONDITIONS


1. Definitions

"The Company" means HESY ENTERPRISE

"Order" means an order placed with the company for the supply of goods.

"Customer"means the person, firm or company from whom an Order is received.

"Goods" means the articles, items or things or any of them described in an Order.

"Contract" means the contract constituted by any Order and its acceptance.

2.) Orders, Acceptance, and Contracts

(i) All Order, Acceptances.and Contracts are subject tothese Conditions and nothing is to vary or override them unless agreed to in writing signed on the Company's behalf. All other conditions and warranties whether expressed or implied by law or trade user are excluded.

(ii) In particular no terms or condition in any order given by any Customer which is inconsistent with these Conditions will apply.

(iii) All brochures, catalogues, manuals and other like material are issued by way of general description only and nothing contained therein nor any representation of whatever kind shall be binding upon the Company.

(iv) Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Conditions.

3.) Description

(i) Any description given or applied to the Goods is given by way of identification only and the use of such description shall not constitute a sale by description. For the avoidance of doubt, the Buyer hereby affirms that it does not in any way rely on any description when entering into the contract.

4.) Delivery

(i) Unless otherwise agreed in writing, delivery of the Goods shall take place at the address specified by the Buyer on the date specified by the Seller. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

(ii) The date of delivery specified by the Seller is an estimate only. Time for delivery shall not be of the essence of the contract and while every reasonable effort will be made to comply with such dates compliance is not guaranteed and the Buyer shall have no right to damages or to cancel the order for failure for any cause to meet any delivery date stated.

(iii) If the Seller is unable to deliver the Goods for reasons beyond its control, then the Seller shall be entitled to place the Goods in storage until such time as delivery may be effected and the Buyer shall be liable for any expense associated with such storage.

(iv) If the Buyer fails to accept delivery of Goods on the delivery date or within 5 days of notification that they are ready for despatch whether prior to or after the delivery date the Seller reserves the right to invoice the Goods to the Buyer and charge him therefore. In addition the Buyer shall then pay reasonable storage charges or demurrage as appropriate in the circumstances until the Goods are either despatched to the Buyer or disposed of elsewhere.

5.) Acceptance

(i) The Buyer is required to test Goods upon delivery and shall be deemed to have accepted the Goods 3 days after delivery to the Buyer. Accordingly, no claim for defect, damage or quality will be entertained (without prejudice to the Seller’s other rights pursuant to these Conditions) unless written notice together with all supporting evidence is received by the Seller within 3 days of delivery. After acceptance the Buyer shall not be entitled to reject Goods which are not in accordance with the contract.

(ii) The Buyer shall not remove or otherwise interfere with the marks or numbers on the Goods.

POLICY


Criteria for Return/Exchange

Customer may request to return/exchange within five (5) working days following delivery date.
1. We reserve the right to offer customers either a direct replacement or an alternative version of the item (shipping cost is non-refundable)

2. If those stocks are moving fast , please allow for stock replacement action.

3. Costs of delivery for goods return will NOT be borne by customers if the loss/ damage occurs during transportation/by post.

4. We shall not be liable for any indirect, special or consequential damage (including without limitation any loss of profits) arising from use of the product purchased.

 

Return/Exchange request WILL be accepted in following cases:

1. Wrong items (Eg.Totally wrong item code, color or style)
2. Items with obvious manufacturing quality problems or defective. (Eg.Missing 1 side of sleeve)

Return/exchange request with processing fee charges will be accepted in following cases:

1. When tag attached to product is removed or package of product is opened and product value is damaged

2. When components of product (including free gift) have been used or lost

3. Minor loose threads, irregular fold or wrinkle produced by crumpling, color differs slightly from the pictures shown online.

4. Item design is slightly different from the picture displayed (e.g. button, pocket, colour or tag)

5. Promotion/Offer/Sale/ Sold Out items are not entitled for exchange.

 

For goods return/exchange, customers MUST:
1. Sent request to us at hesyenterprise@gmail.com within five (5) working days following delivery date.

2. Please state as followings in notification email:
- Email Subject: Warranty - Lelong, Invoice No: xxxx
- Describe type of faulty
- Photo or video of the faulty item received
- Attached invoice(s) copy as proof of purchase.


3. All item should be return in its original packaging including accessories, manuals and instructions.

4. Customers who do not inform us and post the item directly to us will not be entertained.
