You hereby indemnify ComTalk and undertake to keep ComTalk indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by ComTalk to a third party in settlement of a claim or dispute on the advice of ComTalk legal advisers) incurred or suffered by ComTalk arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

Breaches of These Terms and Conditions

Without prejudice to ComTalk other rights under these terms and conditions, if you breach these terms and conditions in any way, ComTalk may take such action as ComTalk deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Variation

ComTalk may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.

Assignment

ComTalk may transfer, sub-contract or otherwise deal with ComTalk rights and/or obligations under these terms and conditions without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire Agreement

These terms and conditions, together with ComTalk Privacy Policy constitute the entire agreement between you and ComTalk in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.

Law and Jurisdiction

These terms and conditions will be governed by and construed in accordance with the laws of Malaysia, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Malaysia.

RETURN and WARRANTY POLICY

Warranty Policy

All new products are subject to the warranty policy of the respective manufacturer. Please refer to the individual product for its warranty period. Return the product within the individual product warranty period.

Dead on Arrival (DOA)

Product is deemed DOA when it shows symptoms of hardware failure or prevents basic operation upon its first use out of the box.

• Please note that original manufacturer’s packaging is part of the product, without the original packaging the product will be deemed second hand and will not be processed.
• If the customer misrepresents the condition of the product, will be returned to you at your own cost.
• Any returned product that is damaged through customer misuse or is missing parts due to customer tampering will not be accepted.
• Product must be deemed DOA by the respective vendor in order for you to receive a replacement unit.
• If the product is reported as DOA after 7 days of receipt, the standard product warranty will apply.
• If the product is deemed by respective vendor NOT to be DOA, the standard product warranty will apply.

Return Policy

• Return the product in its original condition within 7 days of the invoice date. Should you change your mind on the product purchased and allow to exchange once time to other products. *No refund policy. *Note: refund only applicable if the product was out of stock due to End-Of-Life (EOL).
• Your product can be exchanged for other product which same or higher value. Pay the difference of higher value products. No Refund will be given for the difference of lower value products.
• Please call or email our customer service for an RMA Exchange No. before returning your product.
• Exchange product must be returned to our company within 7 days of the invoice date.
• Please ensure you return the product to us UNOPENED in its original packaging for all exchanges.
• Please note that original manufacturer’s packaging is part of the product, so please retain it in case you wish to return them for DOA or exchange.
• The product will be deemed second hand without the original packaging and will not be processed your return and will be returned to you at your own cost.
• Any promotional gift or gift with purchase that have been issued with your order must also be returned UNOPENED along with your product.
